If this purchase is financed, the finance charge, payment schedule, and any insurance premiums are set out in the separate retail installment contract signed at the same time as this Bill of Sale.

Terms of Sale

1. The Purchaser is of legal age and agrees to buy the vehicle described above on the terms set out on every page of this Bill of Sale.
2. This Bill of Sale, together with any retail installment contract, arbitration agreement, or other document signed at the same time, is the complete agreement between the parties and replaces any earlier discussion or promise. Any change to this Bill of Sale must be in writing and signed by both parties.
3. If this is a cash sale (including a cash-equivalent draft from the Purchaser's own lender), the full cash sale price must be paid on or before the sale date shown above, unless the parties agree to a different date in writing.
4. If financing is arranged by the Seller and the Seller is unable to assign the resulting retail installment contract to a lender on terms acceptable to the Seller, the Seller may cancel this sale. If that happens, the Purchaser will return the vehicle in the same condition as delivered, and the parties will be returned to their pre-sale positions, subject to the remaining terms below.
5. If the sale is cancelled for any reason and the Purchaser has been allowed to take possession of the vehicle, the Purchaser must return it on the Seller's request. The Purchaser is responsible for any damage to the vehicle while in the Purchaser's possession and for any reasonable charge for mileage placed on the vehicle after delivery. The Seller may apply any deposit toward those amounts and will refund the balance, if any, to the Purchaser. If the Purchaser fails to return the vehicle promptly, the Seller may recover possession by lawful means at the Purchaser's expense.
6. The Purchaser may cancel this Bill of Sale and receive a full refund of any deposit if the Seller increases the cash sale price after this Bill of Sale is signed.
7. The Seller is not responsible for any delay in delivery caused by events outside of its reasonable control, including supply, transportation, or manufacturer issues. If the vehicle cannot be delivered as described, the Purchaser may either renegotiate the sale or cancel and receive a full refund of any deposit.
8. If a trade-in vehicle is involved: (a) the Purchaser will deliver clean, marketable title at the time of sale, free of all liens except a payoff disclosed on this Bill of Sale; (b) the Purchaser remains responsible for any difference between the payoff stated above and the actual amount required to release the lien; (c) if the trade-in is not delivered with the purchased vehicle, the Seller may reappraise it on delivery, and the Purchaser may cancel this Bill of Sale if the new appraisal is lower and the purchased vehicle has not yet been delivered to the Purchaser.
9. The Settlement above lists every tax included in this sale. The Purchaser is responsible for any tax or fee that becomes due in connection with the sale, the trade-in, or the registration of the vehicle.
10. The Purchaser agrees to sign any other forms reasonably required to complete the sale and to register and title the vehicle, both at the time of sale and within a reasonable period afterward.
11. This Bill of Sale is signed in Nebraska and is governed by Nebraska law, without regard to its choice-of-law rules. If any provision of this Bill of Sale is found to be unenforceable, the remaining provisions stay in effect.
12. If any check or other payment instrument tendered by the Purchaser is dishonored, the Seller may, to the extent allowed by law, cancel this sale, recover the vehicle, or pursue collection, and charge a returned-payment fee permitted under Nebraska law.
13. If anything in a retail installment contract signed at the same time as this Bill of Sale conflicts with this Bill of Sale, the retail installment contract controls.
